12.2 Platform-Related Limitations

We are not liable for any issues that may arise from GoHighLevel’s platform, including but not limited to:

- Service outages or interruptions

- Data loss, breaches, or unauthorized access

- Modifications or limitations to platform features

- Technical failures or performance issues

12.3 Support Protocol

For technical problems directly related to GoHighLevel’s infrastructure, we may refer you to GoHighLevel’s official support team at gohighlevel.com

You agree to assume all risk when using a third-party platform and release River City Spotlight from any liability related to GoHighLevel’s performance or decisions.

13. Use of Artificial Intelligence (AI) Services

We reserve the right to take over the defense of any matter at our own expense, and you agree to cooperate with our efforts to resolve any such claim.

18. Dispute Resolution

This Agreement will be governed by and interpreted according to the laws of the Commonwealth of Virginia, without regard to conflict of laws principles.

18.2 Binding Arbitration Agreement

By using our services, you agree that any dispute or claim related to this Agreement or your use of our services will be resolved exclusively through final and binding arbitration. You waive your right to a trial by jury or participation in any class action. Arbitration will be conducted by the American Arbitration Association under its rules and will take place in Richmond, Virginia.

The arbitrator's decision will be binding and enforceable in any court with appropriate jurisdiction. Class actions and consolidated proceedings are not permitted. If a court determines that any part of this section is unenforceable for a specific dispute, that part may be severed and handled in court, while the rest remains in arbitration.

18.3 Deadline to Bring Claims

19.5 Independent Parties

Nothing in this Agreement creates an agency, partnership, or joint venture between you and River City Spotlight.

19.6 Assignment

19.7 Export Compliance

You agree to comply with all U.S. export control laws when using our services or transferring content.

19.8 Force Majeure

We are not responsible for any failure or delay caused by events outside our control, including natural disasters, war, strikes, outages, or governmental actions.
